TERMS AND CONDITIONS Daily Flowers

Definitions

Daily Flowers: Daily Flowers, located in Amsterdam under Chamber of Commerce (KvK) nr. 81861885. Client: the party with whom Daily Flowers has entered into an agreement. Parties: Daily Flowers and the client together. Consumer: a client who is also an individual and who acts as a private person.

General 1.1 These terms and conditions apply to all offers, orders, and agreements of Daily Flowers, located in the Netherlands, regarding the sale and delivery of flowers and related products to both consumers and businesses. 1.2 By placing an order with Daily Flowers, the client agrees to these terms and conditions.

  1. Offer and Agreement 2.1 All offers from Daily Flowers are non-binding. 2.2 Images and descriptions on the website are indicative. Flowers are seasonal products; variations in color, shape, or availability are possible. No rights can be derived from these descriptions or images. 2.3 If an ordered product or specific color is not available, Daily Flowers reserves the right to deliver an equivalent alternative. 2.4 The agreement is established at the moment Daily Flowers has confirmed the order by email.

  2. Prices and Payment 3.1 All prices are in euros and include VAT. 3.2 Payment is made via the payment methods offered by Mollie Payments. 3.3 Orders will only be processed after receipt of full payment.

  3. Delivery and Transfer of Risk 4.1 Deliveries take place exclusively within the Netherlands. 4.2 If the recipient is not at home, the order will preferably be delivered to neighbors or placed at the front door. The client will be informed about this via email or SMS. This notification serves as proof of delivery. 4.3 Orders cannot be returned if the recipient is not present. 4.4 Daily Flowers ensures careful delivery, but is not liable for damage occurring after delivery, unless there is demonstrable negligence.

  4. Cancellation and Returns 5.1 Canceling an order is possible up to 24 hours before the scheduled delivery date. After this period, cancellation is no longer possible. 5.2 Since the products are perishable, returns are in principle not possible. 5.3 Complaints about incorrect delivery must be reported in writing or by email within 24 hours after delivery. The incorrectly delivered product must be returned in its original condition. In that case, a replacement product will be delivered or the purchase amount will be refunded. 5.4 Complaints about the shelf life of flowers will only be processed if reported within 48 hours after delivery, supported by photos. Daily Flowers reserves the right to assess the complaint. No refund or replacement is offered if the wilting or damage is not demonstrably attributable to Daily Flowers. 5.5 The client is obliged to fully cooperate in the handling of a complaint. This includes allowing the product in question to be returned or picked up within a very short period, given the perishability of flowers. If this is not possible, Daily Flowers may decide not to process the complaint further.

  5. Liability 6.1 Daily Flowers is not liable for damage resulting from the use of the delivered products, unless there is intent or gross negligence. 6.2 The liability of Daily Flowers is in all cases limited to the amount of the original order. 6.3 No refund or replacement is offered for flowers that wilt faster than expected, unless Daily Flowers has demonstrably acted culpably.

  6. Complaints 7.1 Complaints about incorrect or defective delivery must be reported in writing or by email within 24 hours after delivery. Complaints received later cannot be processed. 7.2 Daily Flowers reserves the right to reject a complaint if the products have been handled or stored incorrectly.

  7. Force Majeure 8.1 In case of force majeure, Daily Flowers has the right to suspend or cancel the execution of the order without being liable for damages. 8.2 Force majeure includes: extreme weather conditions, illness of personnel, transport disruptions, strikes, and other situations beyond the control of Daily Flowers.

  8. Privacy and Communication 9.1 Client data is used exclusively for processing orders and will not be provided to third parties, except as necessary for the execution of the agreement. 9.2 Updates regarding the delivery are sent via email and/or SMS. If the product is delivered to neighbors, this will also be reported via these channels. This notification counts as sufficient provision of information.

  9. Intellectual Property 10.1 All rights regarding the content of the Daily Flowers website, including images, texts, and logos, rest with Daily Flowers or its licensors. Use without written permission is not allowed.

  10. Promotions and Discount Campaigns 11.1 Promotions, offers, and discount codes are only valid during the specified period and under the stated conditions. 11.2 Discount campaigns are not valid in combination with other actions, unless stated otherwise. 11.3 Daily Flowers reserves the right to terminate a promotion or campaign prematurely or to adjust the conditions if circumstances give cause to do so.

  11. Cookies and Website Usage 12.1 The Daily Flowers website uses cookies to optimize the user experience and to analyze visitor behavior. 12.2 Functional cookies are necessary for the correct functioning of the website and are always placed. 12.3 For analytical and marketing cookies, prior consent is requested via the cookie banner. 12.4 Information about the use of cookies is included in the privacy and cookie policy on the website.

  12. Applicable Law and Disputes 13.1 Dutch law applies to all legal relationships between Daily Flowers and the client. 13.2 Disputes will be submitted exclusively to the competent court in Amsterdam, unless the law imperatively prescribes otherwise.
